1. Introduction

These Terms and Conditions govern your use of the Shopkiy platform ("the Service"), operated by Shopkiy ("us", "we", or "our"). By creating a store or using our Service, you agree to be bound by these Terms.

2. Seller Accounts

To become a seller, you must create an account and provide accurate information. You are responsible for all activity that occurs under your account.

3. Responsibilities of Sellers

As a seller on our platform, you are solely responsible for:

  • The products you sell, including their legality, quality, and description.
  • Fulfilling orders in a timely and professional manner.
  • Handling customer service, including inquiries, shipping, and returns, according to your own stated policies.
  • Ensuring any outstanding commission fees are paid to keep your store in good standing.

4. Role of Shopkiy

Shopkiy provides the technology platform for you to build and manage your store. We are not a party to any transaction between you (the seller) and your customers. We do not handle inventory, fulfillment, or customer service for individual stores.

5. Payments and Fees

Shopkiy offers a 7-day free trial which provides access to our platform's features. After the trial period concludes, you must choose one of our paid subscription plans (e.g., Basic, Starter, Growth, or Business) to continue service. Subscription fees are billed on a monthly or yearly basis as selected. Failure to subscribe to a paid plan after the free trial will result in the suspension of your storefront until a subscription is activated.

5.1 Subscription Plans & Monthly Traffic Limits

To maintain high platform performance, server stability, and optimal bandwidth for all sellers, Shopkiy applies the following monthly traffic limits per subscription tier:

  • Basic Plan: Allowed up to 5,000 monthly visits (Up to 5k/monthly traffic).
  • Starter Plan: Allowed up to 10,000 monthly visits (Up to 10k/monthly traffic).
  • Growth Plan: Allowed up to 20,000 monthly visits (Up to 20k/monthly traffic).
  • Business Plan: Allowed up to 30,000 monthly visits (Up to 30k/monthly traffic limit allowed).

Stores consistently exceeding their plan's monthly traffic allowance may be required to upgrade to a higher subscription tier to ensure uninterrupted access and high speed performance.

6. Content and Intellectual Property

You retain ownership of all content and products you upload to your store. However, you grant us a license to use, display, and distribute this content as necessary to operate the platform. You must ensure you have the rights to all content you post.

7. Content Disclaimer

Users may only share YouTube links to videos they own or have legal rights to use. Sharing links to videos containing third-party branded content, copyrighted material, or any unauthorized content is strictly prohibited. Links to illegal, pirated, or infringing videos will not be accepted. Any copyright claims, legal issues, or consequences arising from shared links are the sole responsibility of the user.

8. Termination

We may terminate or suspend your account without prior notice or liability for any reason, including breach of these Terms, failure to pay fees, or selling prohibited items.

Additional Terms

Platform Responsibility

Shopkiy is a software platform that enables merchants to create and manage online stores. Shopkiy is not a party to any transaction between store owners and their customers. Any disputes, refunds, chargebacks, product issues, delivery issues, or customer complaints are solely the responsibility of the store owner.

Beta Features

Some features of the platform may be in beta, testing, or under active development. Certain features may not function perfectly at all times. By using Shopkiy, you acknowledge and accept that beta features may contain limitations, bugs, or incomplete functionality.

Service Availability

While we strive to maintain high platform availability, Shopkiy does not guarantee uninterrupted service. Platform uptime may be affected by maintenance, updates, third-party services, hosting providers, internet connectivity, or unforeseen technical issues.

Fraudulent Traffic & Abuse

If we detect bot traffic, automated abuse, spam activity, malicious behavior, fake orders, security threats, or activities that negatively impact platform performance, Shopkiy reserves the right to suspend or terminate the store immediately without prior notice. Subscription fees and payments are non-refundable in such cases.

Prohibited Products & Services

Store owners may not use Shopkiy to sell illegal, counterfeit, stolen, restricted, fraudulent, or prohibited products or services. Any violation may result in immediate suspension or termination of the store.

Legal Compliance

Store owners are solely responsible for complying with all applicable laws, regulations, taxes, permits, licenses, certifications, and business requirements in their country, state, or region. Shopkiy does not provide legal, tax, or regulatory advice and is not responsible for any violations committed by store owners.

Limitation of Liability

Shopkiy shall not be liable for any loss of profits, loss of business, customer disputes, legal claims, penalties, damages, or other liabilities arising from the operation of a merchant's store, products, services, or business activities.

Acceptance of Terms

By creating an account, subscribing to a plan, or using the Shopkiy platform, you agree to be bound by these Terms and Conditions and any future updates made to the platform policies.
